What is the difference between separation and divorce in Alberta?

Separation occurs when spouses live apart with the intention of ending their relationship. This can still occur while parties reside in the same house, while considering various factors. Divorce is only finalized once a Certificate of Divorce is granted.

How are parenting arrangements decided in Calgary?

Parenting decisions are based on the best interests of the child, considering factors such as stability, caregiving history and the child’s needs. These are either in accordance with the Family Law Act or Divorce Act depending on whether the parties are married.

Do all family law matters go to court?

No. Many family law matters are resolved through negotiation or mediation, helping clients avoid the time and costs associated with court proceedings.

Can child support be waived?

No. Child support is the right of the child in accordance with the Divorce Act and the Federal Child Support Guidelines and it cannot be waived by the parties.

Can spousal support be waived?
